Novellum.live User Service Agreement

[IMPORTANT NOTICE]

Welcome to the novellum.live platform (hereinafter referred to as "the Platform"). The services provided by the Platform involve Generative Artificial Intelligence (AIGC) and Deep Synthesis technologies. Before registering or using our services, please read and fully understand this Agreement, especially the clauses regarding limitations of liability, disclaimers, intellectual property rights, and dispute resolution.

If you do not agree to any part of this Agreement, please stop the registration process or stop using the services immediately. Your completion of registration or actual use of the services will be deemed as your acceptance of this Agreement.

Article 1: Definitions and Service Description

1.1 free.ai: Refers to the internet platform operated by Chongqing Spider Data Technology Co., Ltd. (hereinafter referred to as "we," "us," or "our"), providing interactive visual novel creation, play, and sharing services through large language models and deep synthesis technologies.

1.2 Spirit: The in-platform virtual points/props obtained by users through topping up or participating in activities. Spirit can only be used to redeem Generative AI computing resources, specific functions, or digital assets within the Platform. Spirit does not possess the attributes of legal tender and cannot be transferred, traded, or redeemed for cash.

1.3 Deep Synthesis Services: Refers to services that use generative algorithms to produce text, images, audio, etc., including but not limited to AI text dialogue and AI image generation.

Article 2: Account Registration and Compliance

2.1 Identity Verification: In accordance with the Cybersecurity Law and the Provisions on the Administration of Deep Synthesis of Internet Information Services, users must provide a valid mobile phone number from Mainland China for real-name identity verification before publishing information (including stories, comments, etc.) on the Platform.

2.2 Account Security: Your account is for your personal use only. All actions performed through your account (including clicks, purchases, and content generation) are deemed to be your true intentions.

2.3 Minor Restrictions: The services are intended only for adults with full civil capacity. Minors should use the Platform under the guidance and supervision of a guardian. Minors are strictly prohibited from participating in creator revenue settlements.

Article 3: Generative AI Service Specifications (Deep Synthesis)

3.1 Labeling Obligations:

We will add explicit labels (e.g., "AI Generated") in reasonable positions on AI-generated images and text.
We will embed implicit labels in the metadata of synthesized content to ensure traceability.
Users are prohibited from removing, obscuring, or modifying these labels by any means. Users who download and disseminate content are obligated to proactively state that the content is AI-generated.

3.2 Input Standards: Users warrant that the Prompts or other materials they input do not infringe on the intellectual property rights, reputation, portrait rights, or other interests of third parties, and do not contain politically sensitive, obscene, violent, or other illegal information.

3.3 Content Output: As a deep synthesis service provider, we filter illegal or inappropriate inputs through a characteristic database. If the AI generates violating content, we will take actions such as stopping generation, blocking content, or blocking the review process.

Article 4: Intellectual Property Rights

4.1 User-Created Content: You independently own the intellectual property rights to the story outlines, original settings, and non-AI-generated artistic assets you upload. By publishing your work, you grant us a global, free, and non-exclusive license to use the content for promotion, display, and model fine-tuning and optimization.

4.2 AI-Generated Content:

Based on current legal practices, content generated directly by AI generally does not possess the status of a "work" under copyright law.
For co-created content presented through your prompts, parameter settings, and subsequent processing, you bear the relevant revenue rights and legal liabilities.
Creators participating in revenue sharing must ensure that story logic and settings do not infringe on existing copyrights of third parties (e.g., unauthorized fan fiction).

Article 5: Virtual Points (Spirit) Management

5.1 Top-up Rules: Top-up transactions are irrevocable. Once Spirit is redeemed or consumed (e.g., triggering AI drawing), it is non-refundable and cannot be converted to cash, except in cases of system failure resulting in incorrect deductions.

5.2 Creator Settlement: Creator rewards are financial distributions based on content popularity, user consumption, and platform contribution. Creators are responsible for reporting and paying relevant taxes.

Article 6: Disclaimer

6.1 AI Hallucination Risk: AI-generated text may contain logical errors or factual inaccuracies (commonly known as "hallucinations"). The Platform makes no express or implied warranties regarding the accuracy, authenticity, or completeness of the generated content.

6.2 Force Majeure: We shall not be liable for damages resulting from fluctuations in computing resources, GPU server failures, or service interruptions from underlying AI providers.

Article 7: Violations and Penalties

7.1 If we find that a user is utilizing the services for illegal activities (e.g., generating deepfake images that damage others' reputation), we reserve the right to immediately block the account, preserve logs, and report the matter to the authorities.

Article 8: Dispute Resolution

8.1 This Agreement shall be governed by the laws of the People's Republic of China.

8.2 Any dispute arising out of or in connection with this Agreement shall be settled through friendly negotiation; if negotiation fails, either party may file a lawsuit with the People's Court of competent jurisdiction in Nan'an District, Chongqing.
